What is Patient Request Tool?

Patient Request Tool is a secure online service that helps you request copies of your medical records directly from your healthcare provider. Through Patient Request Tool, you can submit a request to access your personal health information, such as visit summaries, test results, or full medical history. Patient Request Tool streamlines the release of information process by allowing you to submit requests electronically and receive records digitally whenever available. Datavant works directly with your healthcare provider to process your request in accordance with applicable laws and privacy requirements.

Acceptance of these Terms

These Terms of Use (“Terms”) are entered into by and between you and Datavant, LLC (“Datavant,” “we,” or “us”). These Terms govern your access to and use of the Patient Request Tool website (“Patient Request Tool”), including any content, functionality, and services offered in association with Patient Request Tool.
By using Patient Request Tool or clicking to accept the Terms of Use, you accept and agree to be bound by these Terms. If you do not agree, do not use Patient Request Tool.
While Datavant powers Patient Request Tool, healthcare organizations may customize how the service appears with their own branding or web address.

Conditions of Use

You may only use the Patient Request Tool to request your own medical records, or to request records for someone else if you are legally authorized to act on their behalf. To submit a request for someone else, you will need to provide documentation verifying your legal authority to act on their behalf.
You agree to provide accurate, current, and complete information when using Patient Request Tool. If you believe that any unauthorized or inappropriate use of Patient Request Tool has occurred, please contact us immediately. We reserve the right to restrict or discontinue access to Patient Request Tool for any reason, including violation of these Terms.
This website is intended for use only by individuals who are considered adults under the laws of their jurisdiction of residence. By creating an account, accessing, or using the Patient Request Tool, you represent and warrant that:
  • You are at least the age of majority in your jurisdiction of residence; and
  • You have the legal capacity to enter into a binding agreement.
If you do not meet these requirements, you may not access or use Patient Request Tool.

Payment for Services

Under federal and state law, your healthcare provider and/or Datavant as its release of information partner are allowed to recover certain costs related to making copies of your medical records available to you. Any fee charged is cost-based to include only the labor, materials and postage as allowed by applicable law.

Privacy and Use of Personal Information

The Protected Health Information (PHI) that you provide while using Patient Request Tool is handled in accordance with our legal obligations as a Business Associate under the Health Insurance Portability and Accountability Act (HIPAA). We process PHI solely on behalf of and at the direction of your healthcare provider, in compliance with applicable privacy and security requirements and our Business Associate Agreements with your healthcare provider. You can review your healthcare provider’s “Notice of Privacy Practices” to understand how your PHI is used and disclosed and your rights under HIPAA.
To the extent we collect any Personal Information through Patient Request Tool other than PHI, such information is subject to our Privacy Policy. By using Patient Request Tool, you consent to our use of your Personal Information as described in the Privacy Policy.

User Responsibilities

You agree to use Patient Request Tool only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:
  • Submit false, incomplete, or misleading information.
  • Request medical records for anyone other than yourself or an individual you are legally authorized to act on behalf of.
  • Interfere with or disrupt the operation of Patient Request Tool.
  • Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempt unauthorized access to any part of Patient Request Tool.
  • License, sell, transfer, assign, distribute, outsource Patient Request Tool or otherwise use Patient Request Tool for commercial purposes or on behalf of third parties.
  • Copy, reproduce, distribute, modify, create derivative works of, or publicly display any portion of Patient Request Tool, except as expressly permitted by these Terms.
  • Use Patient Request Tool for any unlawful, fraudulent, or harmful purpose or in any way prohibited by these Terms.
You affirm that you are authorized to upload relevant information to Patient Request Tool and obtain any and all medical information that may be included in or attached to the response.

Intellectual Property Rights

All content on Patient Request Tool, including text, graphics, logos, and software, is the property of Datavant or its licensors and is protected by copyright and other laws. You may use Patient Request Tool for personal, non-commercial purposes only.
Datavant retains all right, title and interest and all Intellectual Property Rights in and to all components of Patient Request Tool , including the software and platform, Datavant’s confidential information, performance data reflecting the manner, method, frequency, timing, and process of access or use of Patient Request Tool by users, and trademarks and trade names. Patient Request Tool, including the software and platform, is never undertaken or provided to users as a work for hire as such term is defined under U.S. copyright laws. All rights not expressly granted in these Terms are reserved by Datavant. If you provide Datavant with feedback or suggestions regarding Patient Request Tool, you grant Datavant a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable right and license to use the feedback without restrictions or obligation. You are not obligated to provide Datavant with any feedback and any feedback provided is provided “AS IS“.

Third-Party Services and Links

Patient Request Tool may contain links to third-party websites or services. Datavant is not responsible for the content or practices of any third party and your use of such services is at your own risk.

Disclaimers

Datavant is not a healthcare provider, custodian of records, or decision-maker with respect to record disclosure. If you have any questions about your healthcare or the content of your medical records, you will need to contact your healthcare provider.
The completeness and availability of your medical records are the responsibility of your healthcare provider. Datavant does not assume responsibility or any liability whatsoever for the completeness, accuracy, or availability of the information supplied in response to your records request.
We reserve the right to modify or discontinue, temporarily or permanently, Patient Request Tool (or any of its features) with or without notice. You agree that we will not be liable to you or to any third party for any modification, suspension or discontinuance of Patient Request Tool. If Patient Request Tool is not available, contact your healthcare provider directly to submit a records request.
THERE ARE NO REPRESENTATIONS OR WARRANTIES THAT APPLY OR THAT ARE MADE TO YOU IN ANY WAY IN CONNECTION WITH PATIENT REQUEST TOOL OR THESE TERMS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATAVANT DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES WITH RESPECT TO PATIENT REQUEST TOOL AND YOUR ACCESS TO AND USE THEREOF, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR ANY WARRANTIES OF TITLE, NON-INFRINGEMENT AND/OR ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, PATIENT REQUEST TOOL IS MADE AVAILABLE TO YOU ON AN “AS-IS“ AND “AS AVAILABLE“ BASIS AND DATAVANT DOES NOT GUARANTEE, WARRANT OR REPRESENT THAT PATIENT REQUEST TOOL SHALL MEET YOUR REQUIREMENTS OR THAT YOUR USE, OPERATION OR RESULTS OF USE OF PATIENT REQUEST TOOL SHALL BE UNINTERRUPTED, COMPLETE, RELIABLE, ACCURATE, CURRENT, ERROR-FREE, FREE OF COMPUTER VIRUSES OR OTHERWISE SECURE. YOU ASSUME THE ENTIRE RISK OF ACCESSING, UPLOADING TO, DOWNLOADING FROM, OPERATING, AND/OR USING PATIENT REQUEST TOOL. DATAVANT DOES NOT REPRESENT OR WARRANT THAT PATIENT REQUEST TOOL WILL BE ERROR-FREE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED AS SOON AS PRACTICABLE. DATAVANT MAY MAKE IMPROVEMENTS AND/OR CHANGES TO ITS FEATURES, FUNCTIONALITY, OR CONTENT AT ANY TIME.

Limitation of Liability

To the fullest extent allowed by law, Datavant, its affiliates, or suppliers shall not be liable for any damages resulting from your use of Patient Request Tool.
In no event shall Datavant’s total liability exceed $100. Any cause of action or claim you may have relating to these Terms or Patient Request Tool must be initiated within one (1) year after the cause of action occurs; otherwise, such cause of action or claim is permanently barred.

Indemnification

You agree to indemnify and hold harmless Datavant and its affiliates from any claims or losses resulting from your use of Patient Request Tool, violation of these Terms, or infringement of any third-party rights.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware. All disputes shall be resolved exclusively in the courts located in Delaware unless otherwise required by law.

Arbitration

At Datavant’s sole discretion, disputes may be resolved by binding arbitration in accordance with the rules of the American Arbitration Association.

Modifications and Termination

Datavant reserves the right to modify or discontinue Patient Request Tool at any time without notice. We may also revise these Terms periodically. Changes are effective immediately when we post them, and apply to all subsequent access to and use of Patient Request Tool (except changes to the arbitration clause, which will not apply to disputes that Datavant has been notified of prior to making the change). Continued use of Patient Request Tool after changes means you accept the new Terms.

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Datavant.
